These Terms of Service (the “Terms”) govern your access to and use of the website operated by Riwayat E Kalamkar at riwayatekalamkar.com(the “Site”). Please read them carefully. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Acceptance of Terms

By accessing the Site, browsing its content, or submitting any inquiry through it, you confirm that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. These Terms form a binding agreement between you and Riwayat E Kalamkar.

2. Definitions

  • “Riwayat,” “we,” “us,” “our” means Riwayat E Kalamkar, a sole-proprietorship/partnership constituted under the laws of India, having its principal place of business in Noida, Uttar Pradesh, India.
  • “You,” “your” means the natural or legal person accessing or using the Site, whether on your own behalf or on behalf of an entity you are authorised to represent.
  • “Content” means all text, photographs, illustrations, video, designs, marks, logos, layouts, software, and any other material published on the Site.
  • “Inquiry” means any submission you make through the contact form, by email, or by other means inviting us to discuss a potential business arrangement.

3. Eligibility

The Site is intended for use by business users who are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are using the Site on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

4. Description of Services

The Site is an informational and business-development resource. It allows you to learn about our products, manufacturing capabilities, and heritage, and to submit an Inquiry to begin a commercial conversation. The Site does not offer products for direct purchase, and no consumer-facing e-commerce takes place on it.

5. Permitted Use

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Site and its Content for your own internal business evaluation and to communicate with us in good faith about a potential supply relationship. All other uses are reserved.

6. Prohibited Conduct

You agree not to, and not to permit any third party to:

  • Reproduce, copy, sell, resell, distribute, or otherwise exploit the Site or any of its Content for any commercial purpose without our prior written consent
  • Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Site or its underlying software
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notice on the Site
  • Use the Site or any Content to develop, train, or fine-tune any artificial-intelligence model without our prior written consent
  • Use any robot, spider, scraper, or automated means to access the Site or extract data from it, other than well-behaved search engine crawlers
  • Attempt to interfere with the integrity, security, or proper functioning of the Site, including by introducing malware, attempting unauthorised access, or overloading our infrastructure
  • Submit any Inquiry that is unlawful, fraudulent, defamatory, infringing, abusive, or that contains malicious code
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Use the Site in any manner that violates applicable law or regulation

7. Intellectual Property

All Content on the Site, including the brand name Riwayat E Kalamkar, the monogram, photography of our products and craftspeople, illustrations, copy, layout, and the curated selection and arrangement thereof, is owned by Riwayat E Kalamkar or its licensors and is protected by Indian and international copyright, trademark, and other intellectual-property laws.

No right or licence to use any of the foregoing is granted to you except as expressly set out in Section 5. Any use beyond that scope requires our prior written permission. We welcome enquiries about licensing, press use, or republication; please contact us using the details in Section 21.

By submitting an Inquiry that includes content authored by you (for example, a brief, mood board, or specification document), you represent that you have the right to share it with us, and you grant us a non-exclusive, royalty-free licence to use it solely for the purpose of evaluating and responding to your Inquiry. We will not use your materials for any other purpose without your consent.

8. Inquiries Are Not Offers

An Inquiry submitted through the Site is a request for information and discussion only. It does not constitute an offer to enter into a contract, an acceptance of any offer, or a binding commitment by either party. No contract will be formed, and no order accepted, unless and until the parties execute a written agreement (which may include a purchase order confirmed in writing by an authorised representative of Riwayat E Kalamkar) setting out the specific terms of supply.

9. Samples, Orders & Commercial Terms

All samples, prototypes, custom development work, production orders, pricing, minimum order quantities, lead times, payment terms, shipping arrangements, INCOTERMS, warranties, and remedies are governed exclusively by the separate written commercial agreement entered into between you and Riwayat E Kalamkar in respect of the relevant transaction. These Terms do not address, and shall not be construed as governing, any such commercial relationship.

10. Product Descriptions & Imagery

We strive to describe our products and craftsmanship accurately. However, because our products are made from natural fibres and many are hand-finished, slight variations in colour, weight, weave, and texture between pieces are inherent to the craft and are not defects. Photographic representations are illustrative; on-screen colours may differ from physical samples due to monitor calibration, lighting, and browser rendering. Final approval of colourways and finishes should always be made against a physical reference.

11. Third-Party Services & Links

The Site is hosted and operated using third-party infrastructure, including services provided by Cloudflare, Inc., Resend, Inc., Google LLC (for fonts), and ntfy.sh. Use of these services is subject to their respective terms, and we do not control and are not responsible for their availability or behaviour.

The Site may contain links to third-party websites for your convenience. Such links do not constitute an endorsement by us, and we are not responsible for the content, accuracy, security, or practices of any linked third-party site. You access them at your own risk.

12. Disclaimer of Warranties

The Site and all Content are provided on an “as is” and “as available” basis, without warranty of any kind, whether express, implied, statutory, or otherwise, to the maximum extent permitted by applicable law. We do not warrant that the Site will be uninterrupted, timely, secure, error-free, or free from viruses or other harmful components, nor do we warrant that any Content is accurate, complete, current, or reliable. Any reliance you place on the Site or its Content is strictly at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, in no event shall Riwayat E Kalamkar, its principals, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or opportunity, arising out of or relating to your access to or use of the Site, even if we have been advised of the possibility of such damages.

Our aggregate liability arising out of or relating to the Site shall not exceed one hundred Indian rupees (INR 100) or the equivalent amount in your local currency. This limitation does not apply to liability that cannot be excluded or limited under applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Riwayat E Kalamkar and its principals, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with (i) your use of the Site in breach of these Terms, (ii) any Inquiry or content you submit to us, or (iii) your violation of any applicable law or third-party right.

15. Privacy

Our processing of personal information collected through the Site is governed by our Privacy Policy, which is incorporated by reference. By using the Site, you acknowledge that you have read and understood the Privacy Policy.

16. Force Majeure

We shall not be liable for any failure or delay in performance under these Terms to the extent caused by events beyond our reasonable control, including acts of God, natural disasters, epidemics, war, terrorism, riots, civil unrest, governmental action, labour disputes, internet or utility outages, or failures of third-party service providers.

17. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we reasonably believe you have breached these Terms or used the Site in a manner that risks harm to us, to other users, or to our infrastructure. Sections that by their nature are intended to survive termination shall continue in effect.

18. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) are governed by, and shall be construed in accordance with, the laws of the Republic of India, without regard to its conflict-of-laws principles.

Subject to the right of either party to seek urgent injunctive or equitable relief from any court of competent jurisdiction, the courts of Gautam Buddh Nagar (Noida), Uttar Pradesh, India shall have exclusive jurisdiction to settle any such dispute or claim.

19. Changes to These Terms

We may revise these Terms from time to time at our discretion. The revised Terms will become effective on the “Last updated” date shown at the top of this page. Your continued use of the Site after the effective date constitutes your acceptance of the revised Terms.

20. Miscellaneous

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us in respect of your use of the Site and supersede any prior or contemporaneous communications.

Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms freely.

Headings. Section headings are for convenience only and shall not affect interpretation.

These Terms of Service were last updated on 28 April 2026 and are provided in English for international consistency. In the event of a translation, the English version shall prevail.
